These Terms of Use are a contract between you and Barrel of Sunshine Ltd (a company registered in Scotland). By downloading, installing or using Mind Archive on iOS, Android or the web, you agree to be bound by them. If you do not agree, please don't use the app.
Please also read our Privacy Policy, which forms part of these Terms.
Mind Archive is a personal-library app for organising your own content. You can create and manage notes, journals, recipes, PDFs, photo albums, voice memos, files, links, and notice boards with posters — arranged as books on shelves in your personal library. A companion web app is available at mindarchive.io.
You must be at least 13 years old to use Mind Archive (or 16 if you are in the EU, or the equivalent age of digital consent in your jurisdiction). Some regions require you to be 18 to enter into a subscription contract. If you use Mind Archive on behalf of a company or other organisation, you confirm you have authority to accept these Terms on their behalf.
Sign-in is optional for the mobile app, but is required for cloud sync and to use the web app. You are responsible for keeping your credentials secure and for anything done through your account. Tell us as soon as possible if you suspect unauthorised access.
All purchases are made through Apple or Google. Refunds are handled by them under their own policies — we cannot issue store refunds directly. If you believe you have been charged in error, please contact Apple or Google, or email us and we will do our best to help you contact them.
If we change the price of an existing plan, we will notify you at least 30 days before the change takes effect. Where required by law, we will ask for your consent to continue at the new price.
If a renewal payment fails, Apple or Google will keep retrying for a grace period of up to 16 days, during which your library remains fully editable. If payment is still not received at the end of the grace period, the app switches to read-only mode (see section 6). The exact grace-period length is set by the App Store or Google Play and may vary by plan and region.
When a subscription lapses and the grace period ends, Mind Archive enters read-only mode:
You agree not to use Mind Archive to store, share or distribute:
You also agree not to attempt to break the app's security, circumvent our security rules, access other users' data, or reverse-engineer the client in ways that violate applicable law.
If you send us suggestions, ideas or feedback, we may use them freely, without obligation to you and without payment. You will not be identified by name unless you ask us to.
The Mind Archive name, branding, app icon, code, design and content (other than your own content) are owned by Barrel of Sunshine Ltd or its licensors. Nothing in these Terms gives you any right to use them beyond ordinary use of the app.
You can stop using Mind Archive at any time and delete your account from Settings.
We may suspend or terminate your access if you materially breach these Terms, use the app for illegal activity, or in the event that we cease providing the service. If we discontinue the service entirely, we will give you at least 30 days' notice and a way to export your content.
Mind Archive is provided "as is" and "as available". We do our best to keep the service reliable, but we do not guarantee it will be uninterrupted, error-free, or that any particular feature will always be available. You are responsible for keeping your own backups of important content — use the built-in Export feature (Settings → Data Management → Export) and store the file somewhere safe.
To the fullest extent permitted by law, our total liability for any claim arising out of or relating to Mind Archive is capped at the greater of £100 or the amount you paid us in the 12 months before the event that gave rise to the claim.
We are not liable for indirect, consequential, incidental or special damages, or for lost profits, lost data or loss of goodwill.
Nothing in this section limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or for anything else that cannot be limited or excluded by law.
If you use Mind Archive on behalf of a business, you agree to indemnify and hold Barrel of Sunshine Ltd harmless against claims, damages and reasonable costs arising from your misuse of the app, your content, or your breach of these Terms. This section does not apply to consumer users.
These Terms are governed by the laws of Scotland. Disputes will be resolved in the courts of Scotland. If you are a consumer resident elsewhere in the UK or in the EU, you may also bring proceedings in your local courts under mandatory local law.
We may update these Terms from time to time. If we make material changes, we'll notify you via an in-app banner and by email (if we have one for you). Continued use of Mind Archive after the changes take effect means you accept them. If you don't accept, you can stop using the app and delete your account.
Nothing in these Terms affects any statutory rights you have as a consumer under UK or EU law that cannot be waived by contract.
